JPROA Terms and Conditions of Use

Please read the terms and conditions carefully. By logging onto this portal, you must accept and agree to the following terms of use ("terms").

About these Terms

In these Terms, "Service" means the online portal facilitating electronic access to certain records and documents relating to the Jacks Point Owners & Residents Association Incorporated and properties within Jacks Point, operated by (JPROA, Us, We).

These Terms apply to every user and all use of the Service. If you disagree with any part of these Terms then you may not use the Service.

We may modify these Terms and any additional terms that apply to the Service at any time and from time to time. Any changes or updates to the Terms can be viewed on this page. We will not always notify you of such changes. If you do not agree to the modified Terms for the Service, you should discontinue your use of the Service.

Any failure or delay by the JPROA in requiring compliance or enforcing these Terms will not be construed as a waiver of any rights the JPROA may have (such as taking action in the future).

Accounts

1. JPROA Members – you are responsible for safeguarding your log-in ID and password that you  use to access the Service. You agree not to disclose your password to any third party. You must notify Us immediately upon becoming aware of any breach of security or unauthorised use of your account. By creating an account and using the Service, you agree that you have read and understood these Terms and that you will use the Service in compliance with these Terms and all applicable laws, rules, and regulations.

2. Property professionals & third parties – You agree not to disclose your log-in and password to any third party without the prior approval of the JPROA. By creating an account and/or using the Service, you acknowledge that you have the authority to act on behalf of any business or organisation for whom you use the Service, and that business or organisation accepts these Terms. You agree to use the Service on behalf of that business or organisation in compliance with these Terms and all applicable laws, rules, and regulations. You must notify Us immediately upon becoming aware of any breach of security or unauthorised use of your account.

Copyrights and Trademarks

1. Unless otherwise noted, all materials, including logos, images, designs, photographs, video clips and written and other materials that appear on or are accessible through the Service ("Intellectual Property") are protected by copyright, subject to trademarks in favour of, or otherwise owned, controlled or licensed by the JPROA or by third parties.

2. Using the Service does not give you ownership of any intellectual property rights in the Service or the content you access. Nothing on our Service should be construed as granting, by implication, estoppel or otherwise, any license or right to use any Intellectual Property displayed or used on the Service, without the prior written permission of the JPROA.

Privacy

1. Our privacy policy explains how We treat your personal data and protect your privacy when you use the Service. By using the Service, you agree that the JPROA can use such data in accordance with our privacy policy.

2. JPROA Members – Your log-in ID and password provides access for you to information to a selection of your data held by the JPROA and may include accounts, membership, design review board and other information relating to your membership. You can notify the JPROA if any information on the Service should be corrected. You must notify the JPROA immediately upon becoming aware of any breach of privacy relating to your or any other member’s account.

3. Property professionals & third parties – Your log-in ID and password provides access for you to general information about properties and the JPROA. You must notify us immediately upon becoming aware of any breach of privacy relating to any other private information relating to any JPROA member.

Disclaimer

1. To the extent permitted by law, We exclude all warranties and consumer guarantees in respect of the Service. The Service is provided on an “as-is” and “as-available” basis.

2. The Service may evolve and change over time. The JPROA makes no specific promises about the availability, reliability, perceived quality of the Service or its ability to meet your requirements.

Completeness & Accuracy

1. The JPROA does not guarantee that any information or data provided on the Service is correct or complete. Some documents relating to the JPROA or properties within Jacks Point may not be updated or may not be electronically accessible due to their age or data transfer limitations. For this reason, please do not rely on the information available on the Service. All users of the Service need to undertake their own due diligence.

Liability

1. We will not, under any circumstances and subject to all applicable laws, be liable for any damages, loss, costs or expenses (whether arising in contract, tort or any other cause of action), incurred by you or any other person or entity as a result of accessing the Service, downloading information from the Service or relying on information provided on the Service.

2. In all cases, the JPROA shall not be liable indirect loss, damage or other consequential or special damages.

Termination

1. We may terminate or suspend access to the Service at any time and from time to time, without prior notice or liability, for any reason or no reason, including without limitation if you breach the Terms.

2. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
